Terms of service

These Terms of Service ("Terms") are an agreement between you and Smartech-CS LLC, which operates the GovBidWire website, applications and services (collectively, the "Service"). "We", "us" and "GovBidWire" mean Smartech-CS LLC. They govern your access to and use of the Service. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The service

GovBidWire aggregates publicly available government procurement information — including federal opportunities from SAM.gov and state, city, county and school-district solicitations from official public portals — and provides search, email alerts and AI-assisted tools on top of that data.

2. No affiliation with government agencies

GovBidWire is an independent service. We are not affiliated with, endorsed by or sponsored by any government agency, including the U.S. General Services Administration or SAM.gov. Solicitation content belongs to the issuing agencies.

3. Accuracy of information

Procurement data is collected from public sources and refreshed regularly, but agencies may amend, cancel or re-post solicitations at any time. The Service is provided for convenience and research. Always verify dates, requirements and documents against the official source posting before preparing or submitting a bid. We do not guarantee the accuracy, completeness or timeliness of any listing.

4. Accounts

You must provide accurate registration information and keep your credentials secure. You are responsible for all activity under your account. You must be at least 18 years old and use the Service only for lawful business purposes.

One person per login. A login is for a single named individual and may not be shared, transferred or used by more than one person. If your organisation needs several users, the Team plan provides additional seats. Trials. A free trial is limited to one per person and per organisation; creating additional accounts to obtain further trials, or to work around plan limits, is a breach of these Terms and we may suspend the accounts involved.

5. Plans, billing and cancellation

  • The Free plan includes bid search, browsing and one saved search with daily email alerts.
  • Paid plans (Premium and Team) are recurring subscriptions billed in advance through our payment processor, Stripe. Current prices, billing intervals and what each plan includes are shown at checkout and on the pricing page. Team includes a fixed number of named seats; additional seats beyond what is included are billed separately at Premium's published price, not as part of the Team subscription.
  • Subscription term. Your subscription term starts when your first payment is taken and runs for the billing interval you chose — one month on a monthly plan, twelve months on an annual plan. Premium and Team are each offered on either interval; an annual plan is paid once per year, in advance, at the price shown on the pricing page.
  • Automatic renewal, for a term of the same length. At the end of each term your subscription renews automatically for a further term of the same length, at the price then in effect, and your payment method is charged for it. On a monthly plan that is a further month. On an annual plan that is a further twelve months. By subscribing you authorize these recurring charges until you cancel.
  • Switching to annual changes your renewal term. If you move from monthly to annual, the annual term starts on the day you switch and every renewal from then on is yearly, not monthly. Before you confirm the switch we show you the exact amount to be charged that day; afterwards we email you a confirmation stating the new term, the amount and the date of your next charge. Your account page shows the same information at any time.
  • Stopping a renewal. There is no notice period and no form to submit. Cancel at any time up to the moment of renewal from your account page, which opens the Stripe billing portal — you never need to email or call us to cancel. Cancelling stops future renewals; your paid features stay active through the end of the period you have already paid for.
  • Advance notice of annual renewals. For annual subscriptions we email you around 30 days before each renewal. That notice states the amount, the renewal date, the length of the term being renewed and how to cancel before it takes effect. It goes to the email address on your account, so please keep it current.
  • Changing plans. You can switch from monthly to annual at any time from your account page. We credit the unused part of your current month against the annual price and show you the exact amount to be charged before you confirm; nothing is billed until you do. To move from an annual plan back to monthly, email support@govbidwire.com and we will make the change and settle any balance owed to you. This applies to changing plans only — you can always cancel yourself, online, without contacting us.
  • How the charge appears. GovBidWire is a trading name of Smartech-CS LLC. Payments are taken by our processor, Stripe, and appear on your card or bank statement as GOVBIDWIRE. If you see a charge you do not recognise, please email support@govbidwire.com before disputing it with your bank — we can usually identify it and resolve it the same day.
  • Payment method. You authorize us and Stripe to charge the payment method on your account for your subscription and for any usage-based charges you have enabled, including on each renewal. You are responsible for keeping that payment method valid and current; you can update it from your account page.
  • Failed payments. If a charge is declined, Stripe retries it over the following days and emails you. If it is still unpaid after those attempts we may suspend access to paid features until the balance is settled, and may end the subscription. We do not charge late fees or interest on a consumer subscription of this size. Restoring a suspended account is immediate once payment succeeds.
  • AI add-on and usage-based charges. AI features (bid summaries, requirement extraction, compliance checklists, proposal drafts and the chat assistant) are not included in any subscription plan. They are an optional add-on that is off by default. You may enable it from your account page; doing so constitutes your authorization for usage-based charges. Once enabled, each AI request is priced on the number of tokens it consumes, at the rates published on the pricing page, and added to your next invoice, in addition to your subscription fee. You are charged only for AI actions you actively run; ordinary use of the service does not incur AI charges. You set a monthly spending limit when enabling the add-on, and AI features pause once that limit is reached in a billing period. Your month-to-date AI charges are shown on your account page, and you may disable the add-on at any time; charges already incurred remain payable.
  • Refunds — monthly plans. Monthly fees are billed in advance and are not refundable for partial months. Cancelling stops future renewals and you keep access through the end of the month you have paid for.
  • Refunds — annual plans. If you cancel an annual subscription part-way through the year you may choose either to (a) keep full access until the end of the term at no further charge, which is what happens by default when you cancel from your account page, or (b) end the subscription immediately and receive a refund of the unused portion. The refund is one-twelfth of the annual fee for each whole calendar month remaining in the term at the date you ask, rounded down; partial months are not refunded. To choose option (b), email support@govbidwire.com and we will process the refund to your original payment method, normally within 10 business days. Usage-based AI charges already incurred are not refundable.
  • Questions about a charge. If a charge looks wrong to you, tell us within 30 days of the date it appears on your invoice and we will look into it in good faith and correct anything that is our error. Email support@govbidwire.com with the invoice and what you think is wrong. Raising a question with us does not stop your subscription; nothing here limits any right you have to dispute a charge with your card issuer.
  • Currency. All prices, invoices and refunds are in United States dollars unless we state otherwise in writing. Charges made in another currency are converted by your card issuer at its own rate, and any conversion or cross-border fee it applies is not ours and not refundable by us.
  • Taxes. Prices shown exclude sales, use, VAT, GST and similar transaction taxes. Unless we state otherwise, you are responsible for any such taxes and duties arising on your purchase, together with any related penalties or interest, other than taxes on our own income. Where we are required to collect a tax we will add it to your invoice at the applicable rate. If you are exempt, send your exemption certificate to support@govbidwire.com before your next invoice.
  • Price changes. We may change our prices. A change never takes effect part-way through a term you have already paid for: it applies only from your next renewal. We will email you at least 30 days before a price change applies to your subscription, so you have time to cancel before it does. Continuing the subscription after the change takes effect constitutes acceptance of the new price. For annual subscriptions the renewal notice described above states the price that will be charged.

6. AI-generated content

Proposal drafts, chat answers and other AI outputs are generated automatically and may contain errors or omissions. They are a starting point, not professional, legal or contracting advice. You are solely responsible for reviewing, editing and verifying any AI output before using it, including before submitting a proposal to any agency.

7. Acceptable use

  • No scraping, crawling, bulk downloading or other automated extraction of the Service's data or content, and no use of the Service through automated means beyond ordinary browsing and any API we provide to you in writing.
  • No reselling, redistributing, sublicensing or republishing the Service's data or content, or making it available to anyone who is not an authorised user of your account.
  • No sharing account credentials, and no circumventing plan limits, paywalls, rate limits or trial restrictions — including by creating multiple accounts.
  • No excessive or abusive usage that degrades the Service for others; we may apply rate limits and may contact you before restricting an account.
  • No reverse engineering, decompiling or attempting to derive the source code or underlying data structures of the Service, and no vulnerability scanning or penetration testing without our prior written permission.
  • No interfering with the Service, probing its security or using it to violate any law or third-party right or terms.

8. Intellectual property

The Service, including its software, page designs, layout, text, graphics, logos and the selection, arrangement and enrichment of the data it presents, is owned by GovBidWire and its licensors and is protected by United States copyright and trademark law and the laws of other jurisdictions. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your own internal business purposes for as long as your account is in good standing.

What you may do with what you find here. You may view, save and print individual pages, listings and reports from the Service for your own internal use — including preparing a bid. You may not republish, resell, redistribute, sublicense, syndicate or systematically copy the Service or its content, in whole or in part, or use it to build or train a competing product or dataset, without our prior written permission.

Underlying government content. Solicitation notices, attachments and award records originate with the issuing agencies and remain subject to those agencies' own terms and to the rights of their authors. Our rights are in the Service and in how we collect, structure, enrich and present that material — not in the underlying public records themselves.

Any rights not expressly granted in these Terms are reserved. Nothing in these Terms transfers ownership of anything to you, and our trademarks and brand may not be used without our written permission.

9. Termination

You may stop using the Service at any time. We may suspend or terminate accounts that violate these Terms or create risk for the Service or other users. Upon termination your right to use the Service ends, but sections that by their nature should survive (including disclaimers and liability limits) survive.

Getting your data out. Except where we terminate for a serious breach of the acceptable-use rules above, we will give you at least 14 days to export saved searches, pipeline records and company-profile data before the account is closed. You can export this data yourself at any time while the account is active.

Inactive accounts. We may close and delete free accounts with no sign-in for 12 consecutive months. We will email the address on the account before doing so. Paid accounts are not deleted for inactivity while a subscription is in force.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR THAT ANY LISTING IS COMPLETE OR CURRENT.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOVBIDWIRE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE OR BUSINESS OPPORTUNITIES (INCLUDING MISSED BID DEADLINES OR UNSUCCESSFUL PROPOSALS), ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

12. Indemnification

You agree to defend, indemnify and hold harmless GovBidWire and its officers, employees and agents from and against any claims, damages, liabilities, losses and expenses (including reasonable legal fees) arising out of or related to: (a) your use or misuse of the Service; (b) the content, data or inputs you submit (including company-profile data and AI inputs); (c) any proposal, bid or submission you make to any agency; or (d) your violation of these Terms or any applicable law or third-party right.

13. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Subject to the arbitration section below, you and GovBidWire consent to the exclusive jurisdiction and venue of the state and federal courts located in Sacramento County, California for any dispute not subject to arbitration. Nothing in this section deprives you of the protection of any mandatory consumer-protection law of the state in which you reside.

14. Dispute resolution; binding arbitration; class-action waiver

Please read this section carefully — it affects your legal rights. Except for small-claims matters and requests for injunctive relief, any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration, not in court. We first ask that you contact us to try to resolve the matter informally within 30 days.

Arbitration will be administered by the American Arbitration Association (AAA)under its Consumer Arbitration Rules, in effect at the time the arbitration is commenced, and judgment on the award may be entered in any court with jurisdiction. The arbitration will take place in the county where you reside, or by telephone or videoconference at your option, unless we both agree otherwise. Where the AAA rules require it, we will pay the arbitration filing and arbitrator fees that exceed what it would have cost you to file the same claim in court. You and GovBidWire agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. The arbitrator may not consolidate more than one person's claims.

30-day opt-out. You may opt out of this arbitration agreement by emailing support@govbidwire.com within 30 days of first accepting these Terms, stating your name and that you opt out of arbitration. Opting out does not affect any other part of these Terms.

15. General

If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect (severability). These Terms, together with the Privacy Policy and Cookie settings, are the entire agreement between you and GovBidWire regarding the Service. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets.

16. Changes to the service or terms

We may update the Service and these Terms from time to time. Material changes will be posted on this page with an updated date; continued use after changes take effect constitutes acceptance.
